Turkish citizens and Turkish Cypriots who live, work or invest in the Turkish Republic of Northern Cyprus (TRNC) often deal with two legal systems at once. A decision may be issued by a TRNC court, yet the practical result is needed in Turkey: at the land registry, the population registry or the enforcement office.
Maya Avukatlık Bürosu (Maya Law Office) operates in Kartal, on the Anatolian side of Istanbul. The office has no branch in the TRNC; where necessary it cooperates with TRNC counsel and foreign firms. It also handles Turkish files for Turkish citizens living abroad and for foreign clients. Services are provided in Turkish and English.
ℹ️ Quick Answer
A final TRNC court judgment cannot be enforced in Turkey automatically. A recognition decision is needed for it to take effect, and an enforcement (exequatur) decision is needed to enforce it. The process follows Law No. 5718 (the Turkish Private International and Procedure Law, "MÖHUK") and the bilateral judicial cooperation treaty between Türkiye and the TRNC.
Table of Contents
A judgment issued by a TRNC court does not take effect in Turkey on its own, even if it is final. A competent Turkish court must issue a recognition or enforcement decision. The procedure is regulated by Articles 50 to 59 of Law No. 5718 (MÖHUK). In addition, Türkiye and the TRNC are parties to a bilateral treaty covering judicial assistance in civil, commercial and criminal matters, recognition and enforcement, extradition and transfer of sentenced persons.
✅ Legal Basis
MÖHUK Articles 50-59 and the Türkiye–TRNC treaty on judicial assistance, recognition and enforcement are assessed together. In practice, the treaty may also support the examination of the reciprocity requirement.
Decisions of the Turkish Court of Cassation (Yargıtay) also guide the review of these conditions.
⚠️ Point to Watch
The certification procedure needed for TRNC documents to be used in Turkey depends on the treaty and the nature of the file. Missing certification or translation can delay the case. Documents should be checked before they are submitted.
Rather than relying on a fixed rule, each file is assessed by considering the date the judgment became final, limitation periods and the state of the evidence. Delay may cause documents to become outdated and invite objections. Applying promptly after finalisation is therefore recommended. The exact time limit should be confirmed after the file is reviewed.
The estate of a person with assets in both the TRNC and Turkey sits where two legal systems meet. Under MÖHUK Article 20, succession is generally governed by the national law of the deceased, but Turkish law applies to immovables located in Turkey. For immovables in the TRNC, the law of the place where the property is located is decisive. A single document or a single case may therefore not resolve the entire estate.
Whether a TRNC will or inheritance certificate is accepted for land registry and banking procedures in Turkey depends on formal requirements, certification and translation. Because Turkish courts may have jurisdiction over estate matters involving Turkish immovables, a foreign document may not be accepted directly. Review of the file before taking any step is recommended.
The route a creditor takes depends on the type of document held and the location of the debtor's assets:
A foreign judgment for which an enforcement decision has been issued is enforced like a judgment of a Turkish court. To succeed in collection, the debtor's assets in Turkey (real estate, bank accounts, vehicles, receivables) should be researched in advance.
Family law in the TRNC is regulated by the Family Law (Aile Yasası), which is largely based on the Turkish Civil Code. Even so, a divorce decree issued by a TRNC court may not produce effects under Turkish law until it is recognised in Turkey.
⚠️ Risk of an Unrecognised Divorce
Until a foreign divorce decree is recognised in Turkey, the parties may not be treated as divorced in Turkey. The population registry may still show the marriage as continuing, which can cause problems for remarriage and inheritance rights.
Property acquisition in the TRNC is governed by the legislation on acquisition of immovable property and long-term leasing by foreigners. Acquisition depends on Council of Ministers approval and a security check. Under an amendment adopted in 2024, nationals of states that recognise the TRNC and grant reciprocal rights to TRNC citizens (including Türkiye) may acquire up to three houses or apartments, and country-level and district-level quotas apply. As the rules may change, current conditions should be confirmed at the time of the transaction.
Disputes arising from sale promise and construction contracts may lead to claims for title deed cancellation and registration, termination of the contract or compensation.
Maya Avukatlık Bürosu provides legal support in the following areas for TRNC–Türkiye files:
In criminal matters, extradition and transfer of sentenced persons under the bilateral treaty are assessed separately for each file.
Maya Avukatlık Bürosu operates in Kartal, on the Anatolian side of Istanbul. The office serves Turkish citizens living abroad and foreign clients in their Turkish files. Services are provided in Turkish and English.
The office has no branch in the TRNC. For steps that must be taken before TRNC courts, cooperation with TRNC counsel can be arranged where necessary. Such cooperation is set up according to the nature of the file and with the client's knowledge.
The following documents are usually enough for an initial assessment:

MÖHUK determines the competent court, the applicable law and the recognition and enforcement of judgments in cross-border disputes. For Türkiye–TRNC files, the bilateral treaty is added. Each file starts with three questions: Which country's court is competent? Which country's law applies? Can the judgment be recognised and enforced in the other country?
A divorce case filed in the TRNC is heard under the Family Law. Once final, a recognition step is needed for the decree to take effect in Turkey in terms of the population registry and the property regime.
Recognition is sought if only the termination of the marriage must be accepted in Turkey; enforcement is sought if alimony, custody or compensation provisions must be applied.
The judgment, the finality certificate, a sworn translation, a power of attorney and identity details are prepared. The certification method of the documents is checked file by file.
If the divorce is not recognised in Turkey, the spouses may still appear married in the records. When one of them dies, this can lead to disputes over heirship status. The recognition step should therefore not be postponed.
Assets in the TRNC are dealt with under TRNC law and before TRNC courts; assets in Turkey are dealt with under Turkish law and before Turkish courts. The two groups of assets should be planned together.
In Turkey, a certificate of inheritance is obtained from a notary or a civil court of peace, inheritance and transfer tax procedures are completed, and then the land registry and bank transfers are carried out. In cases with a foreign element, the court route may be required.
The will's compliance with formal requirements, its certification and its translation are checked. For immovables in Turkey, the forced-heirship limits of Turkish law cannot be exceeded; if they are, a reduction action may follow.
In Turkey, inheritance and transfer tax is subject to tariffs and exemptions that are updated every year. The TRNC applies its own separate tax system. Current rates and filing deadlines should be confirmed at the time of the transaction.
Acquisition depends on Council of Ministers approval, a security check and quotas. Because the number of homes allowed and the quota rules may change, current legislation should be checked before purchase.
For a lease in the TRNC, the governing law and the competent court are determined first. Lease and eviction disputes concerning property in Turkey are heard in Turkey under the Turkish Code of Obligations.
In Turkey, transfer by inheritance requires a certificate of inheritance, tax procedures and an application by the heirs. Transfer of property in the TRNC is subject to TRNC land registry rules.
The best interests of the child are decisive in custody arrangements. For a TRNC custody decision to be applied in Turkey, enforcement is required.
Turkish law recognises different types of alimony: interim, poverty and child-support alimony. For alimony awarded by a TRNC court to be enforced in Turkey, an enforcement decision is required.
Türkiye has been a party to the 1980 Hague Convention since 2000 (Law No. 5717). Which route applies with respect to the TRNC is assessed case by case; the bilateral judicial assistance treaty and domestic law remedies are reviewed together. Time is critical in these cases, so action should be taken without delay.
In Turkey, protective and preventive orders can be issued under Law No. 6284. Similar protection mechanisms exist in the TRNC. In an emergency, police and emergency services should be contacted first.
If the result of a TRNC case is to be applied in Turkey, it cannot be enforced without a recognition or enforcement decision. It is therefore important to assess from the start whether it is more suitable to file the case in the TRNC or in Turkey.
No. Even if final, a recognition decision is needed for it to take effect in Turkey, and an enforcement decision is needed for it to be enforced.
Generally the court of first instance with civil jurisdiction; in family law matters, the family court. Venue depends on the defendant's place of residence in Turkey (MÖHUK Art. 51).
The decree must be recognised in Turkey. For custody, alimony and property regime provisions to be applied, a separate enforcement case is filed. The suitable route depends on the content of the decree.
In most files, no. The case can be pursued by a lawyer in Turkey under a power of attorney. Depending on the file, the court may request a statement from a party.
The nature of the title deed, mortgage and annotation records, the sale promise contract, Council of Ministers approval and current home and quota limits. Because the rules may change, confirm them before the transaction.
No. The office is in Kartal, Istanbul. Where steps must be taken in the TRNC, cooperation with TRNC counsel can be arranged.
